1. Services

Caliber Solutions provides AI-powered phone receptionist services for local businesses. Our services include automated call answering, appointment booking, FAQ handling, call transcription, call routing, and CRM integration.

We deploy an AI voice agent on your business phone line that answers calls on your behalf, following scripts and instructions configured during your onboarding. The AI agent operates 24 hours a day, 7 days a week.

2. Account Registration

To use our services, you must book a strategy call and complete our onboarding process. You agree to:

Provide accurate and complete information about your business.

Maintain the security of your account credentials.

Notify us immediately of any unauthorized access to your account.

Be at least 18 years of age and have the authority to bind your business to these Terms.

You are responsible for all activity that occurs under your account.

3. Pricing and Payment

Our services are offered at the following price points:

Starter Plan: $349 per month (100 calls included) Pro Plan: $549 per month (400 calls included) Enterprise Plan: $799 per month (unlimited calls)

All plans require a one-time setup fee of $299, which covers AI agent training, script writing, and phone system configuration.

Payments are processed monthly through Stripe. You authorize us to charge your payment method on file each billing cycle. Prices are subject to change with 30 days written notice.

4. Free Trial

We offer a 3-day free trial on all plans. No credit card is required to start your trial. During the trial, you receive full access to all features included in your selected plan.

At the end of the trial period, you will be asked to provide payment information to continue service. If you do not provide payment, your AI receptionist will be deactivated. No charges will be incurred during the trial period.

5. Call Recording Consent

Our services include call recording and transcription. By using Caliber, you acknowledge and agree that:

Inbound calls to your business line through Caliber will be recorded and transcribed.

You are responsible for complying with all applicable federal, state, and local laws regarding call recording consent in your jurisdiction.

You will configure your AI agent greeting to include appropriate recording disclosures where required by law.

Caliber is not liable for your failure to comply with call recording consent laws.

Recordings are stored securely and retained for the duration of your subscription plus 30 days.

6. Acceptable Use

You agree not to use Caliber's services to:

Conduct illegal activities or facilitate illegal transactions.

Make or facilitate robocalls, spam calls, or unsolicited telemarketing.

Harass, threaten, or abuse any person.

Impersonate a licensed professional (doctor, lawyer, etc.) in contexts where doing so would be unlawful.

Transmit malware, viruses, or harmful code.

Violate any applicable laws or regulations.

We reserve the right to suspend or terminate your account for violations of this policy.

7. Service Availability

We strive to maintain 99.9% uptime for our AI receptionist services. However, we do not guarantee uninterrupted service. Scheduled maintenance, third-party service outages (Vapi, ElevenLabs, Cal.com), and force majeure events may cause temporary service disruptions.

We will make reasonable efforts to notify you of planned maintenance in advance. We are not liable for damages resulting from service interruptions.

8. Intellectual Property

All content, software, AI models, branding, and materials provided by Caliber Solutions remain our intellectual property.

You retain ownership of your business information, call recordings, and any data you provide to configure your AI agent.

You grant us a limited, non-exclusive license to use your business information solely for the purpose of providing our services to you.

9. Limitation of Liability

To the maximum extent permitted by law:

Caliber Solutions is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the 3 months preceding the claim.

We are not liable for the accuracy or appropriateness of AI-generated responses during phone calls. While we train the AI agent based on your instructions, AI systems may occasionally provide imperfect responses.

You agree to review and approve your AI agent's scripts and responses during onboarding.

10. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

Your AI receptionist will remain active through the end of your current billing period.

No refunds are issued for partial billing periods.

The one-time setup fee ($299) is non-refundable.

Your call recordings and transcripts will be retained for 30 days after cancellation, after which they are permanently deleted.

Your phone system will revert to its previous configuration.

11. Indemnification

You agree to indemnify and hold harmless Caliber Solutions, AESH Ventures LLC, and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of our services.

Your violation of these Terms.

Your violation of any applicable laws, including call recording consent laws.

Any claims by third parties related to calls handled by your AI receptionist.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.

For material changes (pricing, liability, data handling), we will provide 30 days written notice via email.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of California.
